ORDER FOR SERVICE BY PUBLICATION

 

THIS CAUSE was heard on Plaintiff's Motion by its attorney, Norman J. Rattey, of 95 Main Street, Auburn, Maine 04210, for service pursuant to the M.R.Civ.P. 4(g) upon Defendants Angela P. Haskell (a/k/a Angelina P. Haskell), Alphonso P. Haskell, Lillian Merrill Haskell, Lizzie Haskell Lilly, or Mirriam A. Boomhower, Elizabeth Mae Boomhower Lee, Ella Carrie Boomhower Ekstrom, Lora Boomhower Lypscon or Lester Boomhower, and it appearing that this is a declaration judgment action to clear title to real estate which action will affect the rights and title of such Defendants to the premises described in the attached Exhibit A, and part of the premises described in the deed recorded in the Waldo County Registry of Deeds in Book 194, Page 417.

It appears that the heirs and assigns of Defendants, Angela P. Haskell (a/k/a Angelina P. Haskell), Alphonso P. Haskell, Lillian Merrill Haskell, Lizzie Haskell Lilly, or Mirriam A. Boomhower, Elizabeth Mae Boomhower Lee, Ella Carrie Boomhower Ekstrom, Lora Boomhower Lypscon or Lester Boomhower, cannot, with due diligence, be served by any other prescribed method; and that the addresses of the heirs and assigns of Defendants, Angela P. Haskell (a/k/a Angelina P. Haskell), Alphonso P. Haskell, Lillian Merrill Haskell, Lizzie Haskell Lilly, or Mirriam A. Boomhower, Elizabeth Mae Boomhower Lee, Ella Carrie Boomhower Ekstrom, Lora Boomhower Lypscon or Lester Boomhower, are unknown and cannot be ascertained by reasonable diligence.

IT IS ORDERED that Plaintiff shall cause a copy of this Order to be published once a week for three successive weeks in the Republican Journal, a newspaper of general circulation in Waldo County the first publication to be made within twenty (20) days after the date hereof, and service to be complete on the 21st day after the first publication.

IT IS ORDERED that a copy of this Order as published shall be mailed to the Defendants to the extent that addresses are known.

IT IS ORDERED that any Defendant who wishes to oppose this lawsuit must prepare and file a written answer to the Complaint within twenty (20) days after service is complete, by delivering it in person or by mail to the office of the Clerk of the Maine District Court, 103 Church Street, Belfast, Maine 04915. On or before the day he or she files his or her answer, the Defendant must mail a copy of his answer to Plaintiff’s attorney at his said address.

IMPORTANT WARNING: ANY DEFENDANT WHO FAILS TO FILE AN ANSWER WITHIN THE TIME STATED ABOVE, OR IF, AFTER FILING AN ANSWER, FAILS TO APPEAR AT ANY TIME THE COURT NOTIFIES HIM OR HER TO DO SO, A JUDGMENT OF DEFAULT MAY BE ENTERED AGAINST HIM OR HER IN HIS OR HER ABSENCE FOR THE RELIEF DEMANDED IN THE COMPLAINT. IF ANY DEFENDANT INTENDS TO OPPOSE THIS LAWSUIT, HE OR SHE SHOULD NOT FAIL TO ANSWER WITHIN THE REQUIRED TIME.

If any Defendant believes the Plaintiff is not entitled to all or part of the claim set forth in the Complaint, or if he or she believes that he has a claim of his or her own against the Plaintiff, he or she should talk to a lawyer. If he or she feels he cannot afford to pay a fee to a lawyer, he or she may ask the Clerk of the District Court for information as to places where he or she may seek legal assistance.
